ALAS- RECOVERY ON OVERPAYAMENT -NO FAULT OF PENSIONER- POST 2016 RETIREE

 

Dear Veterans brothers,    please  see the following  peculiar case. 

One Hony.Capt( Sub.Maj) , retired  on Nov 2016 after 33 yrs of service  , sanctioned with  pension  as per 6^th CPC.  because the 7th CPC was announced in 2018 only.

Average emolument – 30990-  pension; 15495 

Then as per 7^th CPC, his pension was revised  as per  Pay Matrix-  Level 10B as

Notional Pay- 67000 +MSP  15500= 82500 and pension- 41250   w.e.f  Nov 2016 and  the other  benefits like commutation and Gratuity. Arrears paid.  pension being paid.

This continued till Jun 2023. 

Then all of a sudden,  in the month of July , his pension  is reduced   i.e  

His  emolument is altered as   61300+15500= 76800 and pension  38400   from

01-11-2016 to 30-06-2023..

Then  from  01-07-2023, his pension is revised as 43675 as per  OROP_ II (Cir 666)in normal way

Thus a difference of   41250-38400= 12850 per month  (1-11-2016 to 30-6-2023) . this is informed as over payment  and also the differential amount of Commutation and Gratuity from Nov 2016  amounting to few Lacs...

The Recovery of over payment started from July 2023 on wards. 

We all know that , in any revision, if the revised Rate is less than the existing Rate, , pensioner  will be allowed to continue to draw the higher rate.   But here  this rule is different  , recovery started.

More over as per DEFENCE PENSION PAYMENT  INSTRUCTIONS (DPPI)  2013,  para 103.2, it says  , if an over payment is noticed after 12 months , it shall not recovered , matter to be  referred to pension Sanction Authority .   in this case  it is noticed after few years. 

So , it is a surprise   and not heard so far  such incidence .
