GOOD NEWS FOR WAR INJURY PENSIONERS.





HAPPY NEWS FOR WAR INJURY PENSIONERS.

As per the latest GOI.MOD letter No. 17(4)/2008 (1)/ D ( Pen & Policy) Vol-V dated 15-2-2011,

the War Injury element is to be calculated in the Minimum Pay in the Pay band applicable to the Rank and Group with effect from 1-1-2006.

Illustration:

Say a Sepoy –qualifying service say 2 yrs, was invalided on 100% disability –pre96 bearing .PPO.No.D/BC/xxxxx

According to theV th CPC rule , the aggregate of Service element plus War injury element should not exceed the Minimum emolument applicable to him. Accordingly, his pension as per VI th Pay commission, CDA cir 410 will be revised as under:

Service Element ..3500

War Injury element ..7020

Aggregate ( SE +WIE)= 10520 plus the eligible rate of DA .

Minimum emolument of sepoy is 5200+2000+2000=9200.

Hence, the War Injury Pension for this Sepoy will be only 9200 plus applicable DA from

1-1-2006 to 30-6-2009.

Then as per the CDA cir 429, the CAP, that is the aggregate of SE+WIE should not exceed the minimum emolument , is removed and the total amount of SE+WIE may exceed the minimum of emolument.

Thus, as per the latest MOD letter , it is to be calculated as under from 1-7-2009 :

Service element: For invalided pensioner , it is 50% of the emolument calculated on the Minimum pay in the Pay band + GP+MSP.

War Injury Element for Invalided pensioner = 100% of Minimum pay in the Pay band +GP+MSP.

For Sepoy ..Pay Band-1 Range-5200-20200 Grade Pay-2000 MSP-2000

Hence Minimum Emolument for this Sepoy will be= 5200 + 2000 +2000= 9200

Service element will be 50% of emolument= 9200 x 50% = 4600 ……………….(1)

War injury Element will be calculated as+ 5200+2000+2000= 9200

100% of Min.emolument = 9200 …………………………….(2).

The aggregate of SE +WIE will be ……..(1) + (2)= 4600+9200= 13800 , it is exceeding the minimum emolument of Rs.9200/- it is OK.

Hence, the War Injury pension for the Sepoy will be Rs.13800 plus the applicable DA.

For less than100% WIE, the it will be reduced proportionately.

Then, for those who were Retired or Released on completion of their term with War Injury Element of 100% disability, the WIE will be calculated at 60% on the Emolument., all other things remaining unchanged.

  5. Dear Sir, I am a battle casualty and got invalided from service in 2005. Can you please throw some light on how to approach the PSA regarding the above circular. When I went to the PSA (in my case its PNB Bank), the officer there could make no sense despite me trying to make him understand the circular. I had taken the copy of the circular along with the referred MOD letter and other supported documents. Is there any authority to whom I can write/meet so that it can sort the matter.
