A NAIK AND HAVILDAR IS GETTING LESS PENSION THAN A SEPOYHOW DO YOU JUSTIFY ?
A JUSTIABLE REMEDY TO REMOVE THE ANOMALY OF A SEPOY GETTING MORE PENSION THAN A NAIK AND HAVILDAR OF SAME GROUP AMD SAME LENGTH OF SERVICE AS PER CDA CIR 430.
Existing pension as per VI th Pay commission- CDA circular-430
Rank Group Qly.Service pension Table.No as per Cir 430

This anomaly may be removed by a simple formula by increasing the weightage
given to NK and HAV by just ONE year. That is:
Weightage for Naik…… 9 years instead of 8 years
For HAV….. 7 years instead of 6 years.
NOTIONAL FITMENT FORMULA : ON MAX SCALE OF PAY AS ON 10-10-1997.
For Naik…….Group A,X… scale of pay …. 3700-85-4975
Maximumof pay….4975 x fitment factor 1.86=9353 rounded to ten= 9360 + GP +MSP
+ X Group pay = 9360+2400+200+1400=15160
Full pension= 50% of pay= 15160/2=7580
Weight age- 9yrs Prorata pension……..7580x(15+9)24/33=5512
Pension of Naik will be Rs.5512
For the Rank of Havildar: Group A,X ---Scale of pay= 4150 – 100 – 5650
Maximum of pay= 5650 x fitment factor 1.86=10509 rounded to ten= 10510 +Gp+
Msp + X gp. Full Pay = 10510+2800+2000+1400=16710
Full pension 50% of pay= 16710/2=8355
Weightage for HAV-7yrs Prorata pension= 8355x(15+7)22/33=5570
Pension of a Havildar- Rs 5570
The MOD accepts that this anomaly is due to the difference in weightage allowable to different ranks, especially in lower ranks. Hence we suggest to increase the weightage by one year to Naiks and Havildars respectively.
In this method, a Naik and Havildar will be getting more than a Sepoy pension,
thus there will be no anomaly.
Our suggestion may be taken in the right spirit and considered for favorable
implementation
The Defence Ministry seems to have gone on appeal to higher court against the order of AFT chandigarh and as such there is no hope of getting any enhanced pension for Honorary Commissione Officers.
