It is heartening to note
that the rate of pension of a Subedar is less than what he was getting as on
1-1-2006.
For example: Table -36 of Cir 430.
A subedar of X group
of 30 yrs of service, retired in the year 2002.
As per the above table, he was getting a basic pension
of 11066 as on 1-1-2006.
Now , according to Cir
547, Annexure- A, his pension is mentioned
as 10280.
What is this- Instead of an
increase, there is a decrease.
Whether the JCO has to
repay ?.
There are three
periods mentioned in the Tables of cir
430,
Prior to 1996, 1-1-1996 to 10-10-1997 and
10-10-1997 to 31-12-2005.
The rate should have been
as per the periods of retirement,
But the Annexure A, B and C
of Cir 547 is prepared just for
one period hence the anomaly.
The affected Subedar is
questioning / asking us whether any
recovery will be made on the basis of this
circular.
There are many such discrepancies in the Annexures A, B
and C..
Affected veterans are
requested to verify their own Rate of pension
and inform the PDAs not to make
any recovery.
There is already a clause ,people who recd higher PENSION on 01012006 will be protected, then, should they again make an appeal not to effect recovery?this is called double jeopardy
ReplyDeleteIt is not the matter of recovery but in this they cleverly avoid the Court verdict. And says if anybody drawing more pension from 01/01/06 that will continue as per the 11.11/2008. Where as the enhanced pension as per circular no 430
ReplyDeleteOn 10/03 2010. and circular no 501 dt Mar 2013 were as per the applicability mentioned that letters respectively. It means no JCO will get nothing as per this circular.
on 24 sep 2012 I am getting 5416 and from 01jul 2009 I was getting 4955 and from jun 2006 I was getting 4132. Now will I get arrears and how to calculate.
