VAGUE CLARIFICATION  - CDA CIR 578.

Referring  Clarification No. 4 of Cir 578:

How to revise &  pay arrears  as per CDA cir568 for
The Rank Last held   -i.e  Junior Warrant Officer of Air Force-
Rank was held for  less than 10 months:

Example: Rank Last held:  JWO  Gp- I   QS  15 yrs 
     Rank for which pensioned…SGT   Gp-I   QS-15.
At present, he is being paid Sgt’s pension only.(8585X2.57)

As per CDA cir 503, 542 the MGP for JWO  GP-I    is 9170  ( 18340/2)
                                                    For SGT  GP-I    is  7445  ( 14890/2)

Now , it is clarified as per CDA cir 578.,that such JWO’s pension may be
 revised  as 9170 w.e.f 1-1-2006 to 31-12-2015  and 9170 X 2.57 from 1-1-16

Here,  Please note that: the Rate  9170  should be up to 30-6-2014 only
 and from  1-7-2014  the OROP rate has to come - it is  10480.(cir 555)
And as per 7th CPC  it should be 10480 X 2.57.

But, this circular says  9170 X 2.57.—

If , some one verifies at a later date, he will compare OROP and 2.57 only.

Hence,we feel a further Clarification is required on this issue.

    Sir, the last rank held is only effected for DL-33 not for OROP, hence the JWO gp I pre2006 retired & not completed 10 months of service in the same rank will be only eligible for 9170 from 1/1/06 to 31/12/15.The OROP is applicable to those who are pensioned in the LRH since beginning.

I feel there should not be any confusion. However after winning the cases​in AFTs of LRH Pension when the authority applies the law universally to grant them the pension for all times in last Rank Held then 10480 would be applicable to them with effect from 1/7/2014.

    i also suffered my rank last held Havildar but rank for pension is NAIK HOLDING rank 8 months compled i wrote ARMY and PCDA and PAOR aUTHORITIES all modify the rank holding policy in CIVIL employer when promoted they get benefits same date ARMY life is short so suggest higher AUTHORITIES TO IMPLEMENT
