ANOMALY IN DISABILITY PENSION OF PRE AND POST 2006 RETIREES.

ANOMALY IN THE RATE OF DISABILITY PENSION.PRE AND POST 2006

  It is heartening to note that Normally  in any revision, the Rates will increase but here it is reduced.    Ref; CDA cir 411.

The Disability Rate as per VI th Pay Commission  CDA Cir 410 and 456, , the Minimum rate of Disability pension for 100% of Disability is Rs.3510/-

That is 30% of the Emolument of pensioner on discharge  with a minimum of Rs.3510/-  for

Pre- 2006 retirees.

And for WAR injury pensioners it is 100%  of emolument for Invalided cases , with minimum of Rs.9200/ and  60% for Release/ discharged cases with a minimum of Rs.7020/ w.e.f 1-1-2006

The Rate varies according to Rank and Groups.

Now as per CDA cir 411 –The Rates for Post 2006 retirees:

Disability pension minimum…………………3100/ - with 30% of emolument   and

War injury  pension…minimum……………9200  for invalided  and

                                                                 6200/- for release /discharged cases.

We have got one Example of Post 2006 case:  as per CDA cir 411

Rank Naik-    Emolument on discharge --- 6920+2400+2000= 11320.

Disability for 100%.................................... 11320*30= 3396

Disability Element sanctioned 20%............  3396*20= 679.2  rounded to 680.  (A)

As per CDA cir 456:

For Naik  - Minimum: Emolument:     5200+2400+2000=9600

              Disability 100%......................9600*30%  = 2880  Which is stepped up to Rs.3510 min.

  If it is for 20%....................................3510*20%=702................(B)

NOTE:

As per V th Pay Commission  - Disability  100%  Mini ………1550  *2=3100 as per Cir 411

                                    War injury – release cases 100% Min.     3100 *2= 6200 as per cir 411

As per VIth  Pay commission…..

Disability  100%.........................Minimum…….1550*2.26=3503  rounded to 3510. Cir 410 & 456

War Injury  release cases………  Minimum  … 3100*2.26 =7006  rounded to 7020.Cir 410 &456

This is an Anomaly.

We are in the opinion that  Pension and other allowances are enhanced for Post 2006 retirees and we are all demanding for pension( OROP) as per the Post 2006 retirees.  But to our surprise , the Rate of Disability pension is reduced as per CDA cir 411-and MOD , Dept.of ESM Welfare

Letter No: 16(6)/ 2008(2)/ 2008/D (Pension/ Policy) dated 5-5-2009.

You will all agree that the injury, pain is the same for both Pre and Post retirees, and  the rate of pension also should be the same.

In earlier occasions , when CDA cir 430 was released, the Pension of Post -2006 retired Subedars was less than that of Pre-2006 Subedars.  We all brought the Anomaly to MOD and Dept.of ESM Welfare and subsequently it was agreed and the Anomaly was redressed by equating the PRE and Post 2006- Subedars pension BY STEPPING UP TO TH HIGHER AMOUNT...

 In the same way this Disability/ War Injury pension also may be equated . i.e the lesser amount may be stepped up to higher amount.

We hope that MOD and Department of ESM Welfare  will l review this  and try to redress the anomaly.
