ONE MORE PRE-1986 AIR VETERAN HELPED FOR ENDORSEMENT OF FAMILY PENSION

The below mentioned Air veteran  approached us for Renewal of 32Kb Echs Card.

Date of enrollment  ………………20-06-1963

Date of Discharge   ………………01-07-1981.

On going through his available documents, we noticed that  he has not applied for Endorsement of Family Pension / Joint Notification so far 

We explained him the importance of Joint Notification  and the Hardship faced by families in the absence of Joint Notification. 

Immediately, we prepared the  Appendix-A and Anexure-II  in Triplicate and guided him to get attestation from his Pension Paying Branch and forward the same to  DAV- Dte. Of Air Veteran –III, New Delhi  through Zilla Sainik board without  any delay. 

The  Veteran and his Wife Smt Suganthi, sincerely thanked us for this valuable, timely help and guidance from Exwel Trust. 

Our Trust is  happy in helping yet another  veteran  for Joint Notification. .

INJUSTICE TO RESERVIST / EX-GRATIA PENSIONERS




             INJUSTICE TO RESERVIST/ EX-GRATIA PENSIONERS 

Reservist pensioners/EXGRATIA pensioners , on completion of 15 yrs ( colour and reserve) period  are sanctioned with Reservist pension and not service pension. 

As per PENSION REGULATION FOR ARMY- 1961 ,  rule 155,  the Reservist  pensioners are eligible for pension  equal to  2/3 of the lowest pension admissible to a Sepoy but  in no case , less than Rs.375 per month on completion of his term of engagement  or prematurely, irrespective of period of colour service..

As per this Rule, the Minimum pension of a Sepoy  as per

 OROP is 6665 per month.

2/3 of this is   6665 =  4444

As per 7th CPC………= 4444 X 2.57= 11422

But they are paid with  9000 only., thus a short payment of more than 2000 p.m 

This is a great INJUSTICE  to Reservist.

We had represented many a time,  including to the anomaly committee.

In the same way, the Ex-Gratia pensioners also completed 15 yrs ( colour and reserve ) period.  Due to opted for Lump sum  amount  and later on refunded,  they are being paid with only 750+375= 1125 as basic  + DA.

They are not eligible for Fixed medical Allowance, and Additional pension after  80yrs of age.  No ECHS facility also.

This is also a great INJUSTICE.

Some veterans approached  AFT and  received favourable Judgement .

We are attaching the  PCDA instruction in this regard  for information of all. 

  very few Ex-gratia pensioners ONLY are alive

But  there are many Reservist pensioners alive. 

All our ESM  organizations are requested to view  this injustice and anomaly to Authorities  where ever possible.

Reservist Pension
Other Ranks of the Armed Forces, depending upon their terms of engagement, serve for specified
number of years in ‘Reserve’. The service rendered while in active service in the Armed Forces is
called “Colour” service and that in reserve is called “Reserve” Service. While the minimum “colour”
service necessary to earn a service pension is 15 years, there are individuals who retire after
completing 15 years of combined colour and reserve service, the latter category of other ranks are
granted “Reservist Pension” in terms of Regulation 155 of Pension Regulations for the Army – 1961
(Part-I).

Monthly Ex-gratia payment to Reservists
Prior to 1-4-68, the other ranks who retired after completing at least 15 years colour plus reserve
service had the option to choose between “Reservist Pension” or “lump sum Gratuity” in lieu.
Reservists who were discharged prior to 1.4.1968 after rendering minimum qualifying service
required for grant of pension but had opted/ accepted lump sum amount of gratuity at the time of
release from service and have not availed benefits of rehabilitation assistance granted by the Govt.
and also are not in receipt of any other pension, are entitled for Exgratia payment of Rs. 600/- per
month with effect from 1.11.1997 plus dearness relief applicable from time to time.

Monthly Ex-Gratia payment to the families of Deceased Reservists
A Reservist, who opted for one time lump sum gratuity in lieu of monthly pension was not entitled
to any pension and subsequently, his family was also not eligible for ordinary family pension.
However, with effect from 1.1.1992 the Widows and dependent children of the deceased Reservists
who had, opted to receive one time lump –sum gratuity in lieu of pension are granted monthly ex
gratia payment of Rs.150/- per month or from the date following the date of death of the deceased
Reservists, whichever is later. The ex-gratia payment has been revised to Rs. 605/- p.m. with effect
from 1.11.1997. Dearness Relief, as notified, will also be admissible in addition.

NON STOPPAGE OF FIXED MEDICAL ALLOWANCE - ECHS MEMBERS.

Dear veteran brothers,

There are still many of our  veterans brothers/ ECHS members  are being paid FMA .

Members have  requested the Banks to stop paying the FMA , but  not stopped, due to this   

our members are put into hardship like Denying Treatment by  ECHS / cancellation of Membership/ confiscation of cards etc.

We had already published  in our blog in this regard.  May 8, 2019

Central organisation , ECHS has issued Advisory  to All Regional Centers  , to Liaise with  Banks, to stop paying FMA on the basis of their  Certificate  for having Stopped FMA. 

 vide  their Letter No;B/ 49711/SC/AG/ ECHS  dated 02-07.2014 

But, this instructions not followed by Regional Centers,ECHS, hence our members are  suffering.

Our Ex-Servicemen Associations are requested  to guide our veterans/ ECHS members  in their area  to verify their  pension slip and confirm that  they are not being paid with FMA .

ATTENTION VETERAN BROTHERS SERIES- 19

 ACCOUNTABILITY  FOR NON STOPPAGE OF  FIXED MEDICAL ALLOWANCE (FMA ) BY BANKS.
Our Ex-Servicemen were enrolled a s member in ECHS from 01-04-2004  onward.
For becoming member, stoppage of FMA certificate from bank is mandatory.
Hence, all the ESM obtained the certificate from their Bank  as Having stopped FMA from so and so month  and joined the scheme from 01-04-2004. ,
Now, we understand that still many ESMs and Families are being paid with FMA.
On verifying  the pension details  for Renewal of ECHS cards to 64 KB,  the
 Non stoppage of FMA is noticed.
The pensioners , particularly Widows not aware whether they are paid with FMA or not.  Similarly, many pensioners also not knowing  this point.
During the Renewal ECHS  cards, we noticed the Non stoppage of FMA . when inquired, they said that they have requested the Bank to stop  FMA  but they are still paying  even after reminding.
THIS IS THE POSITION.
When we calculated the FMA paid to few ECHS members , it comes about Rs.50000 plus,  likewise  many are there.
Here , we wish to know , who is accountable for this Non stoppage of FMA.
The member is having the FMA stopped certificate from Bank.
All pensioners are not that much educated to know the pension details.
We opine that , the Bank is at fault in not carrying out their own commitment, thus the wrong payment.
The Pensioners though not aware of the particulars of their Pension, they are also responsible.
Now who should be held accountable for this happenings.   Is a question.

Now , after coming to know the wrong payment, the Bank is demanding the pensioners to repay the amount in lump sum. The poor pensioners , who   are not having such a large amount  and are finding it difficult to manage

In our opinion,
1.          As the Bank has failed to comply with their own commitment, the wrong payment shall be borne by the Bank itself .
2.          As per Defence Pension Payment Instruction- 2013, item No.103-2, if the wrong payment is noticed after 12 months, the Bank shall not recover the amount. They have to seek permission from  PCDA .  No Bank is following the instructions.
Note:  This is a serious nature.  Some cases has come to our knowledge  that, when the ECHS member  drawing FMA   went  for a Major surgery   and was denied  Treatment / admission  due to this payment   of FMA  which was not of his fault.
The patient was advised to pay back the wrongly paid FMA amount and then only case will be treated / admitted. This is a great injustice meted out to  Ex-servicemen.
As such cases are coming to light, The Regional Offices of ECHS may  take a review of all application of members and  inform the  Banks  to Stop paying the FMA as per their certificate.
IN  view of the above facts, We request all our ESM Associations and Orgs to guide our veteran brothers in your areas in this regard to avoid last minute sufferings.

The below mentioned veteran called on us  for changing the Name of his wife.

Name of his Wife as per Service Records:   K.LATHA

But as per Official Records  like School certificate, Aadhar and PAN cards, the Name Is  V.LATHA MAHESWARI.

We prepared the required Documents,  including News paper publication. 

We guided the veteran  to forward the Documents to his Record Office through his

 Zilla Sainik board. 

The veteran and his wife were very happy with our advise and help

Our Trust is happy in helping  the 6Th case of this nature.

YET ANOTHER VETERAN- 5TH ONE- GUIDED AND HELPED FOR CHANGE OF NAME AND DOB OF WIFE

 On hearing the services of our Welfare Trust, The below mentioned veteran  visited our  Trust for a help  for changing  the Name and DOB of his wife;

Record Office:   Signals  Record

Name of his wife  as per  Official Records-   Matriculation certificate, Aadhar, PAN Cards,  it is U.KANTHIMATHI   and  Date of Birth:  21-05-1955.

 

But ,as per Service Records  in PPO and other  Part II order  it is mentioned as

KANTHIMATHAI    and Date of Birth     21-04-1959.

 

Now,  as per  Army Advisory No:  A/ 20105/MP-8 (I OF R)  (a)  dated  03-04-2018,

We prepared the required Documents  Like Application, Affidavit, Self Declaration

With  proof of  copies of  Official Records, News paper publication and guided him to forward  the set to his Record office through his Zilla Sainik Board.

 

The veteran and his wife were very happy with our service and expressed their sincere thanks for this very useful help and Guidance.

 

Our Trust is also happy in helping the 5th Veteran  for Change of Name and Date of birth.

The Veterans  with such Discrepancies  in Part II order/ PPO  may approach us for Guidance and help.
